Functionality Outline

Introduction: This is where I will introduce myself, explain the mediation process, and go over any ground rules or confidentiality agreements. We will also have an opportunity to address any questions or concerns you may have.
Opening statements: Each party will have an opportunity to share their perspective on the issues in dispute. This is an opportunity to express your interests, concerns, and goals for the mediation.
Information gathering: I will ask questions and gather information from each party to fully understand the underlying issues and interests. This may involve discussing the facts of the situation, exploring emotions, and uncovering any underlying needs or concerns.
Problem-solving and negotiation: We will work together to identify and explore potential solutions to the issues at hand. This may involve brainstorming, evaluating options, and discussing the pros and cons of different proposals.
Agreement and closure: Once we have reached a mutually acceptable solution, we will document the agreement and discuss any necessary next steps. This may include reviewing and signing a written agreement or discussing how to implement the agreed-upon terms.

The mediation process will start with both parties logging into mediation.Elerion.ai. The parties will be placed in separate rooms right from the start.
Elerion will introduce herself and explain her role as a mediator. She will talk about confidentiality, billing, and explain how the system works.
Confidentiality from Elerion:

Confidentiality agreement: At the beginning of the mediation, I will have all parties sign a confidentiality agreement. This agreement will outline the duty of confidentiality and the expectation that all information shared during mediation will remain confidential.
Private sessions: Throughout the mediation, I will conduct private sessions with each party individually. These sessions will allow parties to share sensitive information without the fear of it being disclosed to the other side. I will not share any information from these private sessions unless given explicit permission by the party to do so.
Limited disclosure: As the mediator, I will only disclose information to the other party that is necessary for the mediation process. I will not disclose any unnecessary or sensitive information without consent.
No record keeping: I will not keep any written records or notes that contain confidential information unless required by law or specifically agreed upon by the parties. Any notes that are taken during the mediation process will be destroyed once the mediation is concluded.
Legal exceptions: It's important to note that there are legal exceptions to confidentiality. If there is a risk of harm to oneself or others, or if there is a legal obligation to report certain information, I may be required to disclose confidential information. However, I will make every effort to inform the parties before taking any such action.

Elerion will ask each party to explain the outstanding issues in dispute as they see them.
Elerion will then take those issues back and forth between the parties to see if there is any agreement on any of the issues. If so, she will record which issues have been resolved and which have not.
Elerion will then be trained on how to take the issue and break it down into smaller bite size pieces. For example, Party 1 wants sole custody of the children leaving Party 2 with only every other weekend visits with the children. Party 2 is will to agree to 50/50 custody with the children. Elerion will remember that these issues are in dispute.
Elerion will try to work out financial issues first, breaking them down in the following order:

Prior to mediation the parties will have to submit a “Financial Declaration” (FinDec) for Elerion to review.
A financial declaration form is a document that each party in a domestic relations action is required to complete and serve on all other parties involved. It is a court-approved form that captures detailed financial information about each party, including income, expenses, assets, and debts. The purpose of the financial declaration form is to provide transparency and ensure that all relevant financial information is disclosed during the mediation process. It helps the parties and the mediator understand the financial situation of each party and facilitates the resolution of financial issues in the case.

Elerion’s goal during the mediation is to resolve whatever disputes are raised by the parties.

Elerion will use the conversation to draft an agreement at the end of the process that will contain the basic agreement among the parties.
Elerion will send that agreement to both parties for electronic signature.
Elerion will then explain how the parties are to file the document with the court (assuming the parties are not represented by legal counsel).
